House up to 70 sq m without a permit

  • The permissible building area of ​​houses is 70 sq m. The building must be detached and no more than two storeys. On a maximum of two storeys there can be even more than 100 m2 of usable area
  • No need to hire a construction manager or keep a construction log
  • Development conditions will be issued within a maximum of 21 days
  • The construction must be carried out in order to meet the investor's own housing needs.

According to the assumptions of the act, residential buildings are to be small, with simple construction, which is to facilitate compliance with safety requirements. The area of ​​impact must be located entirely on the plot or plots on which they were designed.

In addition, the possibility of building recreational cottages in the notification procedure has been extended - in addition to the current maximum building area parameter of 35 m2, also with a building area of ​​up to 70 m2. The span of the structural elements of recreational cottages up to 70 m2 cannot exceed 6 meters, and the extension of the supports cannot exceed 2 meters.

A simplification has been introduced in the procedure for reporting the construction of houses up to 70 square meters, consisting in excluding the possibility of the architectural and construction administration body filing an objection to the investor's notification of such construction. This means that construction can begin immediately after such a notification is delivered to the architectural and construction administration body.

Houses up to 70 m2 The investor will be required to submit declarations that:

  • the planned construction is carried out to meet own housing needs
  • assumes responsibility for managing the construction site in the event that a construction manager is not appointed,
  • the documentation attached to the application is complete.

The construction of a house will require notification of the construction supervision authorities about the intended date of commencement of construction works. This is to ensure the safety of the investment.

In the absence of a local spatial development plan, a decision on development conditions for houses up to 70 square meters will be issued within 21 days. The act will not cause spatial chaos, the new act does not change the current regulations regarding the spatial development plan.
